1. About these terms
These Terms & Conditions govern your use of ishvarya.co.in and purchases from Kesoram Poddar Industries LLP, trading as Ishvarya. By using the website or placing an order, you agree to these terms, the Privacy Policy and the policies linked at checkout. Nothing in these terms limits rights or remedies that cannot lawfully be excluded under applicable consumer law.
2. Eligibility and accurate information
You must be legally capable of entering the transaction or use the website with the involvement of a parent or lawful guardian. You are responsible for providing accurate, complete and current contact, payment and delivery information and for safeguarding account access and sign-in codes.
3. Products and descriptions
We aim to describe products accurately. Display colours, packaging details and the appearance of natural materials may vary by screen, batch and production. Fragrance perception is subjective, and format, room size, ventilation, storage and individual sensitivity can affect the experience.
References to deities, offerings, festivals, meanings and ritual practices describe the cultural inspiration behind a product. Practices vary across families, regions and traditions. Ishvarya products do not replace personal religious guidance and do not guarantee spiritual, material, health or other outcomes.
4. Safety and use
Use products only as directed on the pack and website, in a suitable holder on a heat- and fire-resistant surface and in a well-ventilated area. Keep away from children, pets and flammable materials. Never leave burning incense unattended. Stop use if discomfort occurs. Incense is not a medicinal product and is not intended to diagnose, treat, cure or prevent disease.
5. Prices, taxes and availability
Prices, MRP, offers and availability may change prospectively without notice. The price displayed at checkout when you place the order applies, subject to correction of an obvious system or typographical error. Prices include applicable taxes unless the checkout clearly states otherwise. Placing an order does not guarantee acceptance or stock allocation.
6. Order acceptance
An order acknowledgement confirms receipt, not final acceptance. We accept a prepaid order when payment is confirmed and the order enters fulfilment or is dispatched. For Cash on Delivery, acceptance follows order confirmation and entry into fulfilment or dispatch. We may limit quantity or reject or cancel an order for stock error, suspected fraud or misuse, payment failure, an undeliverable location, an obvious pricing error or another legitimate reason. Any captured amount for a cancelled order will be refunded.
7. Payment
Online payment is processed through Razorpay and the payment methods enabled at checkout. Cash on Delivery is available where offered at checkout, with a COD fee of ₹50 or 5% of the full item value, whichever is higher. Combo coupons and discounts apply only to prepaid orders and do not apply to COD. The COD fee is separate from shipping and still applies when your order qualifies for free shipping. You authorise the applicable payment provider to process the amount shown. If payment status is uncertain, do not repeatedly pay; contact us with the transaction reference.
8. Delivery, cancellation and returns
Delivery is governed by the Shipping & Delivery Policy. Cancellation is governed by the Cancellation Policy. Claims for wrong, damaged, defective or incomplete items are governed by the Returns, Replacements & Refunds Policy. Those policies form part of these terms.
9. Accounts
You are responsible for activity under your account except where caused by our failure to use reasonable security. Tell us promptly if you suspect unauthorised access. We may suspend access to protect customers or the service, investigate misuse or comply with law.
10. Ishvarya points
Where a rewards programme is offered, its earning, redemption, availability, expiry and eligibility rules will be shown in your account or in the published programme terms before you use it. Please contact care@ishvarya.co.in for guidance about any existing points or benefits.
11. Promotions
Promotions apply only during the stated period and subject to stated eligibility, stock and redemption conditions. Unless expressly stated, offers cannot be combined. We may refuse a benefit obtained through error, manipulation, duplicate accounts or other misuse, while respecting completed lawful purchases and consumer rights.
12. Acceptable use
You may not misuse the website; interfere with security or operation; attempt unauthorised access; introduce malicious code; scrape or copy content at scale; impersonate another person; submit unlawful, harmful or misleading material; or use the website or products for an unlawful purpose.
13. Intellectual property
The Ishvarya name, logo, packaging, symbols, product names, text, photographs, illustrations, design, software and other content are owned by or licensed to Kesoram Poddar Industries LLP and protected by applicable intellectual-property law. You may use the website for personal shopping and information only. No other use is permitted without written consent.
14. Third-party services and links
The website may rely on or link to third-party services, including Shopify, Razorpay, Shiprocket, couriers and social platforms. Their own terms and privacy practices apply to their services. We are not responsible for unrelated third-party content, but remain responsible for obligations that applicable law places on us as the seller.
15. Liability
To the extent permitted by law, Ishvarya is not liable for indirect or consequential loss that was not reasonably foreseeable, or for delay or failure caused by events beyond reasonable control. We do not exclude liability that cannot lawfully be excluded, including applicable liability for defective goods, fraud, wilful misconduct or mandatory consumer remedies.
16. Force majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, epidemic, war, civil disturbance, government restriction, network outage, transport disruption, carrier failure or labour disruption. We will take reasonable steps to reduce the effect and fulfil or refund affected orders as applicable.
17. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to mandatory consumer-protection rights and the jurisdiction of competent consumer commissions or other statutory authorities, courts at Gurugram, Haryana will have jurisdiction over disputes connected with the website or an order.
18. General
If a provision is held invalid or unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. We may update these terms prospectively by posting a revised version with a new effective date. Terms in force when an order is placed continue to govern that order unless law requires otherwise.
